BREAKING: Federal Court Reinstates Clinton Email Case

Once again, the Hillary Clinton email scandal is back on. A Federal Appeals Court has reinstated the lawsuit.

Huge news that has largely gone unnoticed is now starting to make waves. Thanks to two separate suits brought by Judicial Watch and Cause of Action, a Federal Appellate Court reversed a lower courts decision to dismiss the Clinton Email case.

On December 27, 2016, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit reversed a lower courts decision that judicial proceedings in regards to the Clinton Emails were “moot.”

When Secretary of State John Kerry refused to take all lawful measures mandated by law to recover Hillary Clinton’s emails, Cause of Action and Judicial Watch both brought independent lawsuits with the hopes of launching a Department of Justice investigation. According to Federal Law, the request should have originally came from John Kerry or the national archivist.

“The Federal Records Act governs the creation, management and disposal of federal records,” Senior Judge Stephen Williams wrote for the court, quoting a previous case. “Due to the importance of maintaining federal records (which are generally accessible to the public through the Freedom of Information Act), the act strictly limits the circumstances under which records can be removed from federal custody or destroyed.”

When a Cabinet officer becomes aware that the removal or destruction of federal records has happened or is imminent, he must notify the head of the National Archives, and then “initiate action through the Attorney General” to recover those records.

Even though this is well-known and obviously clear, and it is almost universally acknowledged that Kerry was well aware of this fact, he did nothing. In at least some sense, John Kerry should be charged with the obstruction of Justice, at the very least, now that the lawsuit has been reinstated.
